When you become a free or paid subscriber to Professor EBM, you agree to become bound by the terms of this subscription and license agreement.  Read the following use conditions and disclaimers in this agreement carefully before indicating your acceptance.

 

Professor EBM Subscription and License Agreement

 

LICENSE:  Professor EBM, in consideration of payment of the applicable subscription fee and acceptance of this agreement, grants you a non-exclusive, non-transferable license and right to use and access the Professor EBM database in accordance with the applicable subscription terms.

 

SUBSCRIPTION:  An individual subscription permits one individual to access and use the Licensed Materials by using his or her unique user name and password from any location via the Internet.

 

OWNERSHIP:  The Licensed Materials, including without limitation all copyrights and other intellectual property rights therein, are the sole and exclusive property of Professor EBM, its parent, Santa Clara Valley Medical Center, or its suppliers.  By indicating that you accept these terms, you do not become the owner of the Licensed Materials, but are entitled to use them according to the terms of this Agreement.

 

PERMITTED USES:  You may print out, or email to a colleague, individual teaching modules containing only insubstantial portions of the most current version of the Licensed Materials, but only for 1) your personal clinical or educational use; 2) teaching healthcare professionals; or 3) consulting with individual colleagues, provided that any printed or emailed modules include a source reference to Professor EBM and its copyright notice.  You are not permitted to print or email substantial portions of the Licensed Materials, nor to email individual articles to large number of recipients.

 

PROHIBITED USES:  Except as expressly permitted in this Agreement, any copying, distribution or modification of the Licensed Materials is strictly prohibited.  No part of the Licensed Materials may be copied for resale or other commercial use, or posted on public bulletin boards, websites, Internet domains or online chat rooms.  No part of the Licensed Materials may be reverse engineered or included in other software.  Professor EBM reserves the right in its sole discretion to change and/or cancel an individual’s user name and password without notice in the event of multiple concurrent logins, excessive search quantities or excessive download traffic volumes.

 

SUBSCRIPTION TERM:  You have obtained the right to use and access the Licensed Materials for a specific period of time.  In terms of free access to the Learner’s Guides, this period of time is indefinite.  For paid access to the Teacher’s Guides, you have a right to use and access the Licensed Materials for the subscription period for which you have agreed to pay subscription fees.  At the end of this period, your license and your associated rights will expire automatically, unless you have renewed your subscription on Professor EBM’s then-current terms.

 

RESTRICTION AGAINST TRANSFER:  You may not sublicense, assign, share, sell, rent, lease or otherwise transfer your right to use the Licensed Materials whether by merger, operation of law or otherwise.

 

USE OF PROFESSIONAL JUDGMENT:  The information on this website has been carefully researched.  However, the practice of medicine continues to evolve as new evidence becomes available, and the information in these modules may become outdated.  Users are encouraged to consult with a variety of references and sources.  Only the most current version of the modules on Professor EBM should be consulted.  The Licensed Materials review the evidence on general diagnostic and therapeutic management strategies.  They should not be used as a substitute for professional judgment. 

Content authors, curriculum editors, web developers and all parties associated with this website assume no responsibility that the information contained herein is 100% accurate or complete.  In addition, when medications are prescribed, the user should read the product information sheet packaged with each drug to review approved conditions of use and to note any changes in dosing or side effects.  Mention of specific drugs or products on this site does not constitute endorsement by editors, authors, Professor EBM or its parent, Santa Clara Valley Medical Center.

 

LIMITATION OF LIABILITY:  Professor EBM, its authors, editors, web developers, and its parent, Santa Clara Valley Medical Center shall not be liable to any user or any third person as a result of use of the site by a user, for any claim of any kind, including medical malpractice, negligence or defamation, no matter where brought or how the claim arises.  Moreover, Professor EBM and its parent, Santa Clara Valley Medical Center, do not warrant against interruptions or losses, including loss of data.  There is no guarantee that files available for downloading from this online site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties.

 

LIMITED WARRANTY:  Since users are allowed a free 14-day trial period to examine and use the Teacher’s Guides, neither Professor EBM nor its parent, Santa Clara Valley Medical Center makes any warranty, expressed or implied, with respect to the Licensed Materials, which are licensed “as is.”  All other warranties are expressly excluded and disclaimed, including without limitation any warranty of merchantability or warranty of fitness for a particular purpose, and any warranties arising by statute or otherwise in law or from course of dealing, course of performance, or use of trade.  Any statements or representations made by any other person or entity are void.  You assume all risk as to the quality, function, performance and accuracy as to the quality, function, performance and accuracy of the Licensed Materials.
